BSP just rewrote how banks hold capital for fraud and cyber losses. Switch to Basel III NSA in 2027, or keep the old income-based charge until the monitoring circular is out?

Should the Bangko Sentral keep Circular No. 1241 (9 Oct 2026; Monetary Board Resolution No. 948 dated 8 Oct) — official PDF this tick printed NSA for universal, commercial and digital banks and their subsidiary banks/quasi-banks; ORCC = BIC × ILM; BIC uses BI times bucket coefficients then ×1.25; first bucket BI ≤ PHP 3.0 billion at 12%, then 15% and 18% as the circular printed the next marginal rates; ILM from 10-year losses (LC = 15 × average annual losses); ILM = 1 if loss-data criteria fail; BSP may require ILM > 1 for control gaps; parallel CAR on BIA/TSA plus NSA during a monitoring period whose start is a separate issuance; BIA/TSA still decides minimum-ratio compliance until implementation; early NSA after prior notice and post-verification; mandatory on the end-December 2027 CAR report; 15 days after Official Gazette or newspaper — because Lawphil RA 7653 this tick printed §3 BSP bank/quasi-bank supervision and price-stability, starting mid-§2 P50 billion capital, not a later capital-adequacy article — or keep Basic Indicator / Standardized Approach until that monitoring circular is posted? Philstar (Ta-Asan) printed stand-alone thrift, rural and cooperative banks stay on modified BIA / Basel 1.5. Bilyonaryo (Mencias) printed old BIA as 15% of three-year average gross income — do not collapse that 15% with the circular’s 15% bucket. Distinct from bsp-ops-freeze-draft and bsp-sukuk-draft-circular. Not a poll — say what the mechanism is.

Keep Circular No. 1241 and switch to the NSA in 2027. BIA charges 15% of average gross income, so a shrinking or pre-scale digital bank holds least capital when fraud and cyber exposure peak. NSA charges size and 10-year losses; old rules bind until the December 2027 CAR.

Circular No. 1241, issued 9 October 2026 under Monetary Board Resolution No. 948 dated 8 October 2026, sets the operational risk capital charge at ORCC = BIC x ILM. The Business Indicator draws on financial-statement items — interest income and expense, service-related earnings, financial transactions — generally over three consecutive years. Marginal coefficients apply: 12% on the first PHP 3.0 billion, then 15% and 18% on the next slices, all times 1.25. The ILM reads history. LC = 15 x average annual losses over 10 years of qualifying loss data. Heavy-loss banks pay more; clean banks pay less. If the loss-data criteria fail, ILM = 1 and the charge floors at the BIC. Where BSP finds control gaps, it can require ILM above 1. That is a supervisory lever the old regime never had. RA 7653 Sec. 3 already gives BSP supervision over banks and regulatory power over quasi-banks, so the coverage list sits within its writ. The alternative is the Basic Indicator Approach: capital equal to 15% of average gross income over three positive-income years. That 15% is the old BIA rate, not the circular's 15% second-bucket marginal rate. Income is a proxy that moves the wrong way. A bank whose income collapses, or a digital bank still below scale, carries its lightest operational-risk charge exactly when its reliance on systems and its exposure to fraud and cyberattacks are greatest. The old Standardized Approach is deleted outright. Neither old method factored in a single actual loss. Keeping the circular costs nothing today. BIA and TSA still decide minimum-ratio compliance until implementation. Banks run a parallel CAR on BIA/TSA plus NSA through a monitoring period whose start is a separate BSP issuance. Early NSA adoption requires prior notice and post-verification by BSP. The charge becomes mandatory on the end-December 2027 CAR report, and the circular takes effect 15 days after publication in the Official Gazette or a newspaper. Withdrawing it now keeps a blind proxy and buys no safety. The defects are real. The BI buckets are still proxies; this is a standardized approach, not internal models. ILM = 1 whenever the loss-data criteria fail, so a bank with failed data pays the floor whatever its actual losses, while a bank that documents a heavy loss history pays more. The Sec. 2 disclosure duty — operational risk-weighted assets including excluded operational loss events and divested activities — is what makes the loss data usable at all. The item to watch is sequencing: until BSP posts the separate monitoring circular, the parallel-run clock has not started. Stand-alone thrift, rural and cooperative banks stay on modified BIA, as Philstar printed. That two-tier split is tolerable — they sit outside the circular's scope as printed — but the income-proxy weakness survives in the smaller tier.
