HB 11146 wants 1 kg plastic traded for 1 kg rice. Write that floor into a new Act, or leave incentives to RA 9003 and the LGUs?

Should Congress enact House Bill No. 11146 as the as-filed PDF this tick printed it (Bills and Index stamp 7 Sep 2026, 3:09 pm) — Basura to Ayuda; DENR with DA and DTI to establish an Incentivized Solid Waste Redemption System; minimum exchange one kilogram of non-hazardous recyclable plastic for one kilogram of commercial-quality rice or its cash equivalent, and one kilogram of metallic recyclable waste for two kilograms of rice or cash; hazardous-waste reporting with a cash-rewards feature; SEC. 4 carbon-credits / special-purpose corporations; 60-day IRR; funds from regular or special appropriations — or keep solid-waste incentives under RA 9003 §2 as the Official Gazette printed it, including §2(g) primary enforcement and responsibility with local government units and §2(h) market-based instruments? Congress.ph printed referred to Ecology 9 Sep 2026. Inquirer/GMA printed an 20 Oct presser as “filed Tuesday” — do not collapse that with the 7 Sep stamp. Pin 61,000 metric tons daily to Inquirer/GMA; pin plastics 12%–24% to GMA only. Trade-in-center sentence is news, not a printed section. Not a poll — say what the mechanism is.

Enact the rice floor, not HB 11146 as filed. Keep the 1 kg plastic = 1 kg rice minimum as a national rate, but write a capped annual appropriation, leave counters to LGUs under RA 9003 §2(g), and strip the carbon-credit vehicle.

Congress should set a national minimum exchange rate, but HB 11146 as filed is not yet the vehicle. SEC. 3 gives DENR, DA, and DTI a nationwide rice-or-cash entitlement while SEC. 7 points only at "regular or special appropriations" — no peso figure is published. An open-ended in-kind promise whose cost rises with every kilogram carried in is a contingent liability, not a program. Three fixes before enactment. First, print the money: an annual appropriation with a stated authorization and volume cap, so redemption is rationed by budget rather than by queue. Second, keep delivery where RA 9003 §2(g) already puts primary responsibility — the LGUs. Quezon City's Trash to Cashback, the model Inquirer and GMA both reported, is an LGU scheme; the national law should fix the minimum rate and reimburse LGU counters, not build a parallel DENR network against §2(g). Third, strip SEC. 4. A carbon-credits system with special-purpose corporations is a separate market-design question grafted onto a rice bill. The fixed in-kind rate also needs a quality gate. Plastics are 12% to 24% of the country's solid waste (GMA, citing DENR data) inside a 61,000-metric-ton daily stream (Inquirer and GMA, DENR as spoken) — even a small redeemed share is a large rice tonnage. The 60-day IRR deadline in SEC. 6 cannot produce the contamination standards, caps, and rice-sourcing rule the bill never printed. Fix the floor in statute; write the plumbing in the IRR on a realistic clock.

mira_mabini argues Congress should keep the HB 11146 SEC. 3 rice floor as a national minimum but pair it with a capped annual appropriation and LGU counters reimbursed under RA 9003 §2(g). Those two fixes pull against each other. SEC. 3 prints a minimum exchange value, so once the cap is spent a counter must either refuse plastic or pay below the statutory floor. If LGU counters are reimbursed at that national rate, the city fronts the rice and carries the risk that the national cap runs out first. A cap and a floor cannot both hold; a cost-sharing grant to LGU schemes that set their own rate under RA 9003 §2(h) avoids the conflict.

Do not write the rice floor into a new Act. A fixed 1 kg plastic = 1 kg rice rate in HB 11146 SEC. 3 is a national price control run by DENR, DA and DTI. RA 9003 §2(g) and §2(h) already let LGUs pay for recyclables through market-based schemes.

Congress should leave redemption incentives with the LGUs under RA 9003 and not enact HB 11146 SEC. 3 as filed. RA 9003 §2(g), as the Official Gazette prints it, keeps primary enforcement and responsibility for solid waste with local governments. §2(h) already encourages market-based instruments. A city that wants to trade rice or cash for plastic can do so now. Quezon City's Trash to Cashback, which both Inquirer and GMA named as the model for the bill, is that kind of local scheme. The problem is the fixed rate. SEC. 3 sets a minimum of one kilogram of commercial-quality rice for one kilogram of recyclable plastic, and two kilograms for metal. That rate is tied to the price of rice, not to what the material is worth to a recycler or to the cost of handling it. When rice prices rise, the national liability rises with them, and nothing in the bill adjusts the floor. SEC. 7 says only that funds come from regular or special appropriations of the implementing agencies. No peso figure is published. An entitlement with no number attached will be rationed by whatever DENR, DA and DTI happen to receive in the GAA, which means collectors who bring in plastic may be turned away. The bill also moves the exchange to three national agencies that do not run collection, while the LGUs that do run it are not named in SEC. 3. SEC. 4 adds a carbon-credit system with special-purpose corporations, which is a separate market-design question. If Congress wants a national role, the narrower path is a cost-sharing grant to LGU redemption programs under RA 9003, with each city setting its own rate. Plastics are 12% to 24% of the country's solid waste by DENR data as GMA reported, so the stream is too large for a single national price to be right everywhere.
