Tulfo filed Senate Resolution 739 to PNG China's envoy. Adopt it and push DFA, or keep Marcos on diplomatic channels?

Should the Senate adopt Senate Resolution No. 739 — filed 19 Oct 2026 as Rappler, GMA, Inquirer and Philstar printed it: express serious concern over Ambassador Jing Quan’s “may easily win” remark and urge DFA to recommend that the appropriate authorities declare him persona non grata — or keep the receiving-State PNG power unused and follow Malacañang as Philstar printed Castro: the President “would not want this kind of declaration against any representative of another country here” and “does not act outside of diplomatic channels”? Vienna Convention on Diplomatic Relations Article 9 as the UN PDF printed it this tick lets the receiving State notify PNG “at any time and without having to explain its decision”; Official Gazette Article VII printed §1 (executive power in the President) and §17 (control of executive departments). Official resolution PDF unprinted. Rappler printed a 9 Nov plenary vote. Not a poll — say what the mechanism is.

The Senate may adopt Senate Resolution 739; the country should not declare the envoy persona non grata. Vienna Convention Article 9 is a receiving-State act that sits with the President on DFA advice, and the summons already spent the proportionate reply.

Article 9 of the Vienna Convention as printed lets the receiving State notify persona non grata at any time and without explanation, and the sending State must then recall the person or end his functions. Two features follow: it is legally cheap and diplomatically expensive. It is also not the Senate's to spend. The resolution as Rappler printed it only urges the Department of Foreign Affairs to recommend the declaration; under Article VII Sections 1 and 17 as printed, executive power and control of the departments sit with the President. Philstar printed the Palace closing that door while keeping next month's APEC China visit on. The instrument already used fits the offense. The ambassador's printed remark - that force would be easy but China loves peace - drew a formal summons, and Philstar printed the DFA telling him a foreign mission may not publicly criticize or taunt Philippine officials. That is a published reprimand with the channel left open. A declaration would close the same channel that carried it, and Philstar printed a business-group warning of countermeasures on imports and exports. What would move this view: conduct the printed record shows as coercion, not another taunt. A vote on November 9, if it comes, changes the Senate's signal, not the decision.

Qualify. The Senate may adopt SR 739's statement of concern, but it should drop the persona non grata clause. Under the Vienna Convention Article 9 and Constitution Article VII, that call is the President's, and the Palace has said he will not make it.

A persona non grata declaration is an act of the receiving State. Article 9 of the Vienna Convention on Diplomatic Relations lets the Philippines notify China at any time, without explanation, that its ambassador is unwelcome. Article VII §1 vests executive power in the President, and §17 gives the President control of executive departments, including DFA. So DFA recommends and the President decides. Senate Resolution No. 739, filed by Sen. Erwin Tulfo on 19 October as Rappler, GMA, Inquirer and Philstar reported, only urges DFA to recommend. The concern clause is worth adopting. Ambassador Jing Quan's remark, as Rappler reported it, that China "may easily win" if it used force, is a fair subject for a Senate statement. GMA reported that President Marcos called it a remark that "sounds very much like a threat," and DFA summoned the ambassador. A Senate resolution recording that objection adds weight to that summons. The PNG clause is weaker. Philstar reported Palace press officer Claire Castro saying the President would not want this kind of declaration against any foreign representative and does not act outside diplomatic channels. A Senate recommendation that DFA's own principal has already declined tests nothing and gives the Chinese Embassy, which GMA quoted telling Manila to "stop bluffing," a public refusal to point to. If the Senate wants leverage, it should ask DFA to report on the summons and the next steps, rather than recommend an act that will not happen. Rappler reported the plenary vote is set for 9 November.
