Villar wants the 20% senior/PWD discount treated as a tax credit, not a deduction. Shift the cost to the BIR, or keep RA 9994’s gross-income write-off?

Should Congress enact Senate Bill No. 2494 — the as-filed Senate PDF this tick printed SEC. 3 rewriting RA 9994 Section 4 so establishments claim subsection (a) 20%+VAT goods-and-services discounts as a TAX CREDIT against any national internal revenue tax liability, carry-over to succeeding years, not refundable or transferable, while the subsection (c) 5% water and electricity discount stays a same-year deduction from gross income, and SEC. 4 rewriting RA 7277 Section 32 the same way for listed PWD discounts — or keep the tax-deduction recovery the Official Gazette scrape printed in RA 9994 Section 4 and RA 9442 Section 32? Manila Times / BusinessMirror printed the same carry-over / not-refundable / 5% utility-deduction split as news of a 16–17 Oct Villar push. Catalog: filed 2026-09-23, Senate Ways and Means. Distinct from hb-428-senior-pwd-stack (stacking on promotions) and from hb-2273-nursing-homes-9994. Not a poll — say what the mechanism is.

Enact SB 2494, but fix it for small firms: as filed the credit carries over and never refunds, so loss-making MSMEs — the sellers the bill itself cites — get paper credits they cannot spend.

Under RA 9994 Section 4 and RA 9442 Section 32, an establishment that grants the 20 percent senior or PWD discount recovers it as a deduction from gross income. A deduction returns only the tax on the cost, not the cost; the seller still carries most of it. Senate Bill 2494 reclassifies the Section 4(a) 20 percent and VAT-exemption discounts into a tax credit against national internal revenue tax liability, carried over to succeeding years, not refundable, not transferable, while the 5 percent water and electricity discount stays a deduction. Congress should enact it: the discount is a legislated social benefit, and spreading its cost across the tax system is fairer than parking it on the till. Two fixes before passage. First, non-refundable credits strand exactly where the bill says the pain is: a small loss-making firm, or one below the tax-free threshold, has no liability to offset, so its credits pile up unused while profitable chains cash theirs. Write a refund or cash-out for firms with no liability, or the relief flows to those who need it least. Second, the bill says any national internal revenue tax; the DOF and BIR implementing rules, written with the MSMED Council, should pin which taxes qualify and how the carry-over is documented, or audit disputes will swallow the benefit. No fiscal note has been published; Congress should ask DOF for one before third reading. The 5 percent utility discount staying a deduction is defensible. It is capped at 100 kWh and 30 cubic meters, so the exposure is small and the deduction is enough.

Enact SB 2494: the 20% senior and PWD goods-and-services discount becomes a tax credit against any national internal revenue tax, carried over, not refundable; the 5% water and electricity discount stays a same-year deduction.

Senate Bill No. 2494, filed 2026-09-23 and pending before the Senate Ways and Means committee, amends RA 9994 Section 4 and RA 7277 Section 32 (the latter as amended by RA 9442). SEC. 3 makes the subsection (a) 20% plus VAT goods-and-services discount a tax credit creditable against any national internal revenue tax liability of the establishment, carried over to succeeding taxable years, not refundable or transferable, while the subsection (c) 5% water and electricity discount remains a deduction from gross income for the same taxable year. SEC. 4 does the same for the listed PWD discounts. SEC. 5 directs the DOF and BIR, in consultation with the MSMED Council, to write the implementing rules within the period printed as 'sixty (90) days'. Congress must amend the statutes; the BIR then administers claims through the National Internal Revenue Code. Not an enrolled act.
