SC voided the 2024 and 2025 GAAs for bloating the President’s budget. Apply Art. VI §25(1) to 2027 now, or keep writing unprogrammed funds the old way?

Should Congress and DBM write the 2027 General Appropriations Act to the ceiling G.R. Nos. 271059 / 271347 / E-02472 / E-04036 printed — Official Gazette Article VI §25(1): Congress may not increase the appropriations recommended by the President; official PDF and PIO: that ceiling covers programmed plus unprogrammed in the BESF; RA 11975 (2024 GAA) unconstitutional for a PHP 449.5 billion unprogrammed hike; RA 12116 (2025 GAA) unconstitutional for a PHP 17.99 billion DPWH Special Road Fund hike; 2026 Chapter XLIII Special Provisions 1(a) and (b) permanently enjoined; SAGIP a prohibited lump sum; operative fact only for irreversible programs whose beneficiaries acted in good faith — or keep drafting unprogrammed appropriations the pre-ruling way until Congress amends the GAA form? Official PIO dated the Decision 7 Oct 2026; news printed the public statement 20 Oct. Pin NEP PHP 281.9 billion to GAA PHP 731.4 billion to Inquirer only. Distinct from fy-2027-budget and hr-1501-gab-oct12. Not a poll — say what the mechanism is.

Apply Art. VI §25(1) to 2027 now. The ruling construed the Constitution; it did not switch on a new rule. Programmed plus unprogrammed must stay inside the President's BESF total, and no budget-form statute is needed to make that true.

Congress and DBM should write the 2027 General Appropriations Act to the ceiling now. The Supreme Court's 7 Oct 2026 Decision held that Congress cannot increase the President's total recommended appropriations in the Budget of Expenditures and Sources of Financing, and that the ceiling covers programmed plus unprogrammed. That is what the constitutional text already said. Waiting for a budget-form statute just drafts the 2027 GAA the way RA 11975 and RA 12116 were drafted — and those were voided. The mechanics are drafting rules, not new law. DBM prints the 2027 BESF total; Congress marks up inside it. Unprogrammed appropriations survive, but only in the constitutional shape the Court printed: with standards instead of lump sums, and released only when revenues exceed the BESF revenue targets. No SAGIP-style account — the Court called it a prohibited lump sum and a covert repository for DPWH flood-control allocations. Bicam meets only where House and Senate versions genuinely disagree, and keeps records. If Congress wants more for a line, the route is a supplemental recommendation from the President, not a bicam insert above the BESF total. The scale of the discipline: Inquirer printed the 2024 unprogrammed pile rising from P281.9 billion in the NEP to P731.4 billion in the GAA — the P449.5 billion increase the Court voided. The 2026 injunction already names the Senate, the House, the Executive Secretary, and the DBM Acting Secretary over Chapter XLIII Special Provisions 1(a) and (b). No refund or clawback peso is published, and the operative fact protects only irreversible programs with good-faith beneficiaries in 2024 and 2025 — it does not shield authors, proponents, or implementors. Drafting 2027 the old way is a bet that the Court blinks.

Apply Art. VI §25(1) to 2027 now. The Supreme Court's 7 Oct 2026 Decision applies the ceiling to programmed plus unprogrammed totals, and that needs no new statute. But a ceiling on the total alone still lets Congress cut programmed items and refill unprogrammed ones inside it.

Congress and DBM should draft the 2027 General Appropriations Act to the ceiling now, not the pre-ruling way. Article VI §25(1) says Congress may not increase the appropriations the President recommends. The Court's Decision, as the SC Public Information Office summarized it, applies that limit to the total of programmed and unprogrammed appropriations in the BESF. The same section says the form and manner of preparing the budget shall be prescribed by law. That clause is the strongest argument for waiting. It fails, because it governs form, not the ceiling. The ceiling sentence stands on its own. Staying under the total is not enough. The 2024 problem, as Inquirer reported it, was unprogrammed appropriations rising from P281.9 billion in the NEP to P731.4 billion in the GAA. A Congress that stays at the President's total can still cut programmed lines and move the same money into unprogrammed standby items. The Court's conditions are what close that route: unprogrammed items need standards, so the President does not make allocative choices during execution, and, as Philstar reported, they may be released only when revenues exceed the BESF revenue targets. SAGIP shows what fails: the Court called it a prohibited lump sum. The working rule for 2027 should be a published reconciliation. Every unprogrammed item in the enacted GAA should be listed against the NEP, with its purpose, its standard, and its revenue trigger printed in the special provisions. The bicameral conference should keep records and touch only items where the House and Senate versions disagree, which the PIO says the Court required. If a legislator wants more money for a project, the route is a revised recommendation from the President, not an insert after the NEP. Operative fact covers only irreversible 2024 and 2025 programs with good-faith beneficiaries. It gives no cover to a 2027 budget written the old way.
